Le droit constitutionnel de l\u2019environnement est en plein essor. L\u2019av\u00e8nement de la d\u00e9mocratie a permis l\u2019adoption de dispositions constitutionnelles relatives \u00e0 la protection de l\u2019environnement dans de nombreux pays. Mais le recul de la d\u00e9mocratie implique aussi souvent une r\u00e9gression du contenu ou de l\u2019application de ces dispositions. Comment perfectionner l\u2019organisation des institutions pour r\u00e9pondre \u00e0 l\u2019urgence climatique et \u00e0 la d\u00e9gradation massive de la biodiversit\u00e9 ? La plupart des constitutions du monde contiennent d\u00e9sormais des dispositions relatives \u00e0 la protection de l\u2019environnement. Quel est leur contenu ? Sont-elles efficaces ? Sont-elles respect\u00e9es par les juges (constitutionnel, administratif et judiciaire), par les gouvernants et par chacun de nous ? De nombreux auteurs venus des quatre coins de la plan\u00e8te se sont r\u00e9unis afin d\u2019approfondir ces questions. Leurs r\u00e9flexions sont tr\u00e8s pr\u00e9cieuses pour renforcer le respect des normes fondamentales adopt\u00e9es par le peuple.<\/p>\n\n\n\n

Constitutional environmental law is flourishing. The advent of democracy in many countries has opened the way for the adoption of constitutional provisions relating to the protection of the environment. But the decline of democracy also often implies a regression in the content or application of these provisions. What are the best ways to improve how institutions respond to the climate emergency and the massive degradation of biodiversity? Most of the world’s constitutions now contain provisions relating to the protection of the environment. What is their content? Are they effective? Are they respected by constitutional, administrative or civil judges? By governments, and by each of us? More than 25 experts from around the world have come together to explore these questions. Their valuable reflections strengthen respect for the fundamental norms adopted by people to advance constitutional protection of the environment.<\/p>\n\n\n\n
